INTRODUCTION:
These are the terms and conditions of HAREMLONDON.COM (the *Company*), owned by HAREMBATH LTD, which applies to all items ordered online from HAREMLONDON.COM the (*Website*). Please make sure that you read these terms before placing an order. By using the Website or purchasing an item from the Company, you agree to these terms and conditions, which is part of the contract for the sale and purchase of goods made between the Company and you. In this article, “the customer”, “you” and “your” refers to the individuals who use, place an order and purchase good from the Website, whereas “we”, “us”, “the Company” and “HAREMLONDON.COM” refers to HAREMLONDON LTD.
These terms and conditions may change from time to time, without providing any advance notice to you. Therefore, it is your responsibility to check these terms before a each purchase. Once you place your order, you will be bound by the terms that apply to that order.
PLACING AN ORDER:
By placing an order via the Website you are making an offer to the Company to purchase the goods detailed in your order upon the terms described in your order. You can place an order by using the ordering process on the Website. This involves selecting the goods, placing them in the shopping cart and transmitting the order to us by clicking on the “Pay Now” button. This process permits you to check and alter any errors or in the order before placing an order. We will send you a confirmation email after your order but please note this is not a confirmation that your offer to purchase the goods (or for them to be delivered) has been accepted. A contract between you and the Company for the sale and delivery of our goods will only exist once an order has been accepted i.e. when you receive a confirmation email.. Your credit/debit card/PayPal account will be authorized when your order is placed and processed but you will not be charged for the value of the goods until the point that they are dispatched to you. This does not affect your statutory rights. If any goods are unavailable, we will notify you of the unavailability as soon as possible and will arrange for a full refund if you have been charged.
Prices and availability of goods are subject to change without notice.
PRODUCTS AND PRICES:
The price charged for each item, shall be the one that is published on the Website. Liability of the Company shall in no circumstances exceed the original value of the price charged for the goods. The contracts from the sales of goods by the Company shall be subject to and governed by English law.
The Company reserves the right at all times to revise any of the prices of the products to take into account any increase in costs to the Company due to factors beyond it’s control, including but not limited to exchange fluctuations, alteration of duties, increase in cost of labour and/or materials and/or transport.
Our weights and measurements of our goods as outlined in the product description are as accurate as possible.
DELIVERY DATES:
It is the Company’s priority to deliver the orders on time to the customers, however, any delivery date given by us are approximate only, due to the fact that we are working with an external parcel company. Therefore although we will do our best to adhere to delivery times, a contract will not be terminated as a result of reasonable delay.
We envisage for all UK deliveries to be made within 3-5 days of dispatch. International deliveries might be subject to longer timescales depending on courier used.
RETURN AND REFUND POLICY:
The Company is confident with how accurate the products look and appear on the Website. However, on online purchases from www.harembath.com or orders via email, our costumers can still request a refund, in writing, within 14 days from the date of placing the order on our Website. Due to hygiene reasons, items, which have been washed, laundered or used, cannot be accepted for refund. The products must be returned in the same condition in which they were received. Damaged or altered goods, due to customers’ negligence will not be accepted. With the exception of faulty goods, all goods returned are at the customers’ expense. When returning your item, you are responsible for insuring the package for the full purchase price. The arrangement of collecting the items will be arranged once you have contacted us.
Once the item is received, our Quality Assurance department will check and approve the condition of the product in line with our returns policy conditions. The Company will then refund you the purchase money.
On Pop Up Shop Purchases, once a customer tried a product in store and bought the product afterwards, products cannot be refunded. Harem London reserves the right to refuse a refund once the customer decided to return the product with no damages or faults. In case, Harem Bath would exchange the product with another colour. Other requirements may be refused by Harem Bath.
Cancellation; Customers have the right to cancel a purchase; at any time before the item has been dispatched. After the item is despatched you will be liable for the delivery cost of the return.
RISKS:
The risk in goods shall pass to the customer as follows;
-Where the Company delivers the products to the customer, then as from their arrival at the point where they are to be unloaded; or
-Where the customer collects the products, then as from the point where they are collected (provided that when the products are loaded onto vehicles loading shall be the responsibility of and the risk of the customer.
The title to the goods shall not pass to the customer until all amounts for the time being due and owing from the customer are received in full by the Company.
For as long as the customer remains in possession of any HAREMLONDON products, whilst title remains with the company, the customer shall be fiduciary agent of such goods for the company.
If the customer shall re-sell any product that the Company produces, the customer shall hold the proceeds of sale thereof (or any debt due to the customer representing the same) upon trust for the company and the customer shall not permit such proceeds of sale to be mingled with its own monies. Any such debt due to the customer which is subject to such trust shall upon demand be assigned by the customer to the Company together with all such other rights (if any) as the customer may have against its debtor for the recovery of the same.
PRIVACY POLICY:
We do collect information of you, all our customers. The information we ask and need are; your name, your home address, e-mail address, your age as well as credit card details for payment method and the delivery address. Every customer has their own account with their personal information. This helps us to track what you buy personally. We do not see or hold your credit card details.
The Company does not share any of the information belonging to its customers with other parties, for any reason. We have taken all reasonable steps to maintain site security. We use licensed e-commerce software, supported by a specialist web service provider and arrange payment through PayPal.
